Having regard to Regulation (CE) n. 1151/2012 of the Council of the 21^st of November 2012, relative to quality schemes of agricultural products and foodstuffs;

Having regard of the law n. 526 of the 21^st of December 1999, laying down provisions concerning the fulfilment of the obligations deriving from the membership of Italy to the European Community – Community law 1999;

Having regard of art. 14 of the above-mentioned law of the 21^st of December 1999, n.526, and in particular of sub-paragraph 15, which identifies the functions for the exercise, among which the Consortia for protection of DOP, IGP and STG can receive the corresponding responsibility from the Ministry for Agricultural, Food and Forestry Policies, through measures of recognition;

Having regard of ministerial decrees of the 20^th of April 2000, published in “Gazzetta Ufficiale della Repubblica italiana – Serie generale – n.97 of the 27^th of April 2000”, laying down general provisions relative to requisites of representativeness of Consortia for the protection of designations of origin (DOP) and of protected geographical indications (IGP), and individuation of criteria of representation in social organs of Consortia for the protection of designations of origin (DOP) and of protected geographical indications (IGP), emanated by Ministry for Agricultural, Food and Forestry Policies, in accordance with art. 14, sub-paragraph 17 of the above-mentioned law n. 526/1999;

Having regard of the Regulation (CE) n. 813 of the Commission of the 17^th of April 2000, published on “Gazzetta Ufficiale delle Comunita’ europee L.100” of the 20^th of April 2000, with which the protected denomination of origin «Aceto Balsamico Tradizionale di Modena» was registered;

Having regard of the decree of the 16^th of October 2009, published on “Gazzetta Ufficiale della Repubblica italiana – Serie generale – n. 257” on the 4^th of November 2009, with which it was attributed the recognition and responsibility to perform the tasks relative to art. 14, sub-paragraph 14, of the law of the 21^st of December 1999, n. 526 for DOP «Aceto Balsamico Tradizionale di Modena»;

Having regard of the decree of the 18^th of May 2016, published on “Gazzetta Ufficiale della Repubblica italiana n. 130” of the 6^th of June 2016, with which it was confirmed, as most recently, to the Consortium for the protection of Traditional Balsamic Vinegar of Modena the responsibility to perform the tasks relative to art.14, sub-paragraph 15, of the law of the 21^st of December 1999, n. 526 for DOP «Aceto Balsamico Tradizionale di Modena»;

Having regard of the law of the 28^th of July 2016, n. 154, and in particular to art. 2 that introduced sub-paragraph 17-bis of art. 53, of the law n.128/1999, on the basis of which the statute of Consortia for protection shall foresee that the department of administrators to elect is carried out according to a criterion that assures equity between genders;

Having regard of the communication transmitted by certified e-mail (PEC) on November 27, 2017 (prot. Mipaaf n. 85482), with which the Consortium for the protection of Traditional Balsamic Vinegar of Modena transmitted the consortial statute in accordance to the previsions pursuant to art.2 of the 28^th of July 2016, n.154;

Having regard of the legislative decree of the 30^th of March 2001, n. 165, laying down general provisions about the regulation of employment depending on public authorities, and in particular to art. 16, letter d);

Having regard of the directorial directive 2017 of the General Direction for the promotion of agricultural quality and horse racing of the 20^th of March 2017, in particular art.1, sub-paragraph 4, with which the proprietors of the non-general managerial offices, in line with the respective decrees of responsibility, are authorized to sign the acts and provisions relative to administrative lawsuits;

It is therefore considered necessary to proceed with the approval by Consortium for protection of Traditional Balsamic Vinegar of Modena of the new version registered in Modena on the 20^th of March 2017, number 3842, signed by Notary Maurizio Zivieri.

It is therefore decreed: New text of the statute of the Consortium

The modifications to the text of the statute of the Consortium for protection of Traditional Balsamic Vinegar of Modena registered in Modena on the 20^th of March 2017, number 3842, signed by Notary Maurizio Zivieri.

Such decree is published on the Gazzetta Ufficiale della Repubblica italiana.
